Utility Model Patents
Utility Model Patents (UMs) provide protection for products that feature new shapes or unique structural physical attributes. With a UM, applicants can secure early patent protection, benefiting from immediate coverage while awaiting the longer-term security that an eventual invention patent may offer. Typically granted within one year, Utility Model Patents are valid for ten years from the filing date.
Design Patents
Design Patents protect original designs that have not been previously published or used in China or abroad. Filing for a Design Patent before any product sales in China is crucial to preserving the patent's ‘novelty’ status. Design Patents are usually granted within one year and offer a ten-year protection term from the filing date.
